The Decree 33/2025, published in the Official Gazette on January 16th, 2025, establishes significant modifications to the antidumping system in Argentina, aiming to promote competition and ensure a more transparent foreign trade. Dumping is defined as the practice of exporting products at lower prices than those in the domestic market of the exporting country. To apply antidumping measures, it must be demonstrated that this practice causes significant harm to national production, based on objective evidence regarding its impact on prices and local producers. The decree seeks not only to protect the local industry, but also to improve conditions for consumers by fostering a more competitive environment.
The main points of the decree are summarized as follows:
Duration of Antidumping Measures
Antidumping measures, which could previously be renewed indefinitely, will now have a maximum duration of three (3) years, with the possibility of a single extension for an additional two (2) years.
Streamlining Investigations
The time frame for conducting dumping investigations has been reduced from 12 months to a maximum of 8 months, thus facilitating a quicker response to complaints.
Simplification of Procedures
The management of antidumping procedures will be centralized within the National Commission on Foreign Trade (CNCE), eliminating the need to submit documentation to multiple agencies, thereby aiming to simplify the process and reduce bureaucratic inefficiencies.
Enhanced Oversight and Participation
New entities will be incorporated into case analyses, such as the National Commission for the Defense of Competition (CNDC) and the Undersecretariat for Consumer Defense, balancing the interests of businesses and consumers, ensuring that decisions consider and uphold public interest.
